Executives Urge CFTC to Establish Prediction Market Safeguards

Major U.S. interactive platform executives urged federal regulators to establish consistent consumer protections, market integrity rules, and advertising standards during a Commodity Futures Trading Commission advisory committee meeting as prediction markets rapidly expand.

DraftKings CEO Jason Robins called for identical regulatory standards across all access points within prediction markets to ensure uniform consumer safety regardless of the platform structure.

"The rules for customers going directly to DCM versus those going through an FCM should be identical," Robins said. "There really is no distinction from the consumer protection perspective."

Addressing tensions among market participants over contract integrity and platform models, Robins cautioned against productive debates turning into counterproductive industry conflicts.

"Try to refrain from taking shots at each other's business models or decisions you may not 100% agree with," Robins said. "That doesn't advance the discussion. All it does is sow divisions and distract the discussion towards debates that really aren't productive."

Fanatics Betting and Gaming CEO Matt King highlighted potential financial risks facing retail users, emphasizing the necessity of proactive standards to avoid industry-wide fallout.

"While a vast majority of customers will use these products for profit or for fun, there is a small chunk of them that will have a problem using them," King said.

King noted that early regulatory leadership could prevent negative outcomes for customers utilizing emerging commercial trading tools.

"I think we have an amazing opportunity because of the leadership in this room to take a leadership position around the issue and set super clear standards from Day 1," King said.

FanDuel President Christian Genetski prioritized building user confidence through equal rules and heightened regulatory oversight across key operational areas.

"The most critical thing we can do for prediction markets right now is to build consumer trust," Genetski said. "The way to do that is to have clear rules of the road and a level playing field for all the participants."

CFTC Chairman Michael Selig concluded the proceedings by reaffirming the agency's commitment to federal oversight, confirming ongoing work with Congress to enhance federal preemption and consumer safeguards.
