DraftKings Launches Prediction Market Contracts in California

DraftKings expanded its financial predictions platform into California on August 24, 2026, offering event contracts despite the state's ongoing legal prohibition on traditional sports betting.

The expansion places the company alongside existing prediction competitors Kalshi and Polymarket in the state. These platforms allow users to trade contracts tied to varied outcomes, ranging from musical charts and political elections to sporting events.

Federal oversight by the Commodity Futures Trading Commission allows these event contracts to operate under different regulatory classifications than traditional gambling, effectively exempting the platforms from state-level wagering bans.

California voters previously blocked traditional gaming expansions in 2022 by rejecting Proposition 27, which sought to legalize online wagering, alongside Proposition 26, which aimed to permit sports betting on tribal lands.

Tribal leadership identified the state's massive population as the primary driver behind gaming operators targeting the market.

"And so, because of that, all of the gaming operators are looking at California as an essential piece of what's going to make them viable as they move forward," said James Siva, Chairman of the California Nations Indian Gaming Association.

Tribal representatives previously backed Proposition 26 while opposing Proposition 27 due to concerns over revenue impact.

Siva expressed concern that growing prediction platforms could reduce revenue streams directed toward tribal communities that rely on casino operations for employment and local government funding.

Operational differences also exist between gaming models, as prediction platforms permit participation starting at age 18, compared to the 21-year age minimum required for traditional sports betting.
