Kroger Agrees to 17 Million Pharmacy Overcharging Settlement

Grocery retailer Kroger agreed to a $17 million class-action settlement following allegations that the company overcharged insured customers for generic prescription medications across its nationwide store pharmacies, including subsidiaries like Mariano's. The lawsuit, originally filed in an Ohio court in 2021, claims Kroger failed to factor in lower prices available through its Kroger Savings Club program when reporting its usual and customary prices to insurance providers. According to lawsuit allegations reported by WSLS, this pricing practice caused insured pharmacy customers to pay higher out-of-pocket costs for generic prescription drugs between December 9, 2018, and August 23, 2026.

Plaintiffs brought claims of fraud, negligent misrepresentation, and unjust enrichment against the grocery chain, alleging that insured customers were denied access to lower prescription rates provided to discount club members.

Kroger denied all allegations of wrongdoing and maintained that it correctly reported its retail prices, arguing that Savings Club discounts were available only to customers who paid an annual membership fee. The grocery retailer agreed to settle the litigation without admitting liability, according to court documents and reporting by WXIA.

Under the proposed agreement, customers in the United States and its territories who used insurance to cover all or part of a prescription filled at a Kroger-owned pharmacy during the eligible period may qualify for payout. The settlement administrator established two claimant categories: known claimants who received direct notice with a Claim ID, and unknown claimants who must submit supporting documentation to verify eligible purchases.

Settlement funds will be distributed on a pro rata basis depending on total valid claims and individual prescription spending, with payments per plaintiff not expected to exceed $5,000 after court fees and legal costs are deducted. The settlement administrator noted that additional verification or purchase records will be required for individuals submitting claims totaling $8,000 or more. "You will be asked to provide information proving that you are a member of the Settlement Class," the administrator website said.

Administrators indicated that claimants who did not receive an initial settlement notice may still apply by submitting proof of purchase online.

"You will be contacted by the Settlement Administrator and asked to provide supporting documentation or data sufficient to identify your eligible purchases," the website said. Eligible claimants have until December 21, 2026, to file a claim online, by phone, or by mail, while exclusion requests must be submitted by October 22, 2026. Approved payouts will be issued via paper check, direct deposit, PayPal, Venmo, or Zelle within 120 days following final court approval, with a final approval hearing scheduled for January 11, 2027.
